Open Question: How to Vacate A troublesome Tenant?

I have rented out my DDA Flat to an advocate for residential purpose in New Delhi @ Rs 12,000 PM and a security of Rs 24,000. The Agreement is on a Stamp Paper for 11 Months. He paid me the 1st and 2nd Month Rent on Time but the 3rd Month rent (Feb 2010) was delayed by around 14 days and this month (March 2010) rent is still due for over 12 days now. He is stating the reason that right he does not have any money to pay the rent. I am staying in my sister's house with my father ( Senior Citizen) and the rent that we used to get from our tenant was given to my sister. As we have not received this months rent till now and also the previous was delayed, it is becoming embarrassing when my sister asks me for the money. Me and my father want to move back to our rented house to avoid any conflict between me and my sister. The Terms and conditions require a notice of 1 month. As he is a Lawyer, i am sure he would have figured a way of holding on to our house and not pay us the rent. I am not sure what to do. Can anyone please give me an advise.
