Open Question: my brother and me are co owners of a pproperty.his share is 11% only.now i want constuct a home in this?

property.i tried to give his share as cash. but he not agree. if i approach court for partition,it will take time.can i give indemnety bond in court to construct home soon. i can't wait until end of partition suit.
